Literary non-fiction most likely refers to a work of literature tat relays a true event, but also incorporates element of a fictional story. This applies to In Cold Blood, differentiating it from straight crime reporting by adding the fictional elements and an elaborate story line. I think Capote employed this writing style in order to evoke emotion in the reader. As a result of this form of writing, the reader is left feeling almost sympathetic for one of the killers (Perry Smith) when they normally would not feel such a way toward a murderer. This stylistic choice enhanced the realness of the gruesome story.
