I believe there is a difference. A true crime story is based on facts and mystery . The gathering of evidence and facts creates an anxious and mysterious tone. For the reader this pulls them in because it can easily be something they can relate to it from news and tv entertainment. In non fiction books there are less specific facts and more situations building suspense in the book. It's less relatable because they know it's not real. It still builds up an anxious feeling but the lack if specific facts makes it more like a story and less like a real event.
